On Sunday, Ajay Mishra announced that no case was pending against him, a day after his vehicle was among the three vehicles that killed four farm protesters in Lakhimpur Keri, Uttar Pradesh.

The family members who filed the petition claim that they now live in constant fear. “We are taking all precautionary measures as the Opposition is now the Union Home Minister,” said Rajiv Gupta, 45, a businessman from Lakhimpur Kerry.
Gupta’s older brother, Prabhat Gupta, was shot dead on July 8, 2000, “while out shopping”. Prabhat was then 28 years old. Misra and three others – Subhash’s uncle, Sashi Bhushan and Rakesh alias Talu – were accused along with Prabhat’s family of being the downfall of the “political rivalry”.
In 2004, a local court in Lakhimpur Kerry acquitted all four, including Misra, after which the state government approached the High Court when the victim’s family filed a review petition.
According to the PTI report, the petitions were taken up for hearing and the Lucknow Bench of the Allahabad High Court adjourned the judgment till March 12, 2018. However, the verdict was re-listed before Justice Devendra Kumar Upadhyay and Justice Dinesh Kumar Singh announced the session and further investigation is required, the report said.
The Allahabad High Court website shows that the case was last taken up on February 5, 2019.
Rajiv Gupta said, “Since the day we filed the revision petition, we have been under constant surveillance by the people of Ajay Misra.
Although Ajay Misra could not be reached for comment, three of his lawyers denied the allegations and pointed out that the local court was guilty of firing on Sanjeev Gupta Misra, the brother of Prabhat and Rajiv. Court
Rajiv Gupta confirmed the incident and said it happened after Prabhat was shot dead. “My brother Sanjeev is in jail now. But Misra also registered false cases against my family members for harassing us,” he said.
Misra’s lawyers Salil Kumar Srivastava and Gajendra Pratap said they were not aware of the status of the revision petition. “Ajay Misra and others were acquitted in the murder case,” Srivastava said.
Misra, a resident of Panveerpur village in Lakhimpur Kerry, has long been associated with the BJP and held various positions in the party’s district wing. In 2012, he successfully contested the Assembly elections on a BJP ticket from Nixon. He has been the Lakhimpur Gary MP since 2014.
According to Misra’s confession for the 2012 election, he faced three charges, including one murder, and two counts of criminal intimidation and injury. The affidavit states that he was acquitted in all cases.
Another Misra lawyer, Avdesh Singh, said: “There is currently no case pending against Ajay Misra.”
Speaking to reporters after the incident on Sunday – farm protesters accused Misra’s son of driving a vehicle that had entered them – Ajay Misra said “the local police opened a history sheet in his name because he worked for various social causes in the district.” ”. “I have challenged it in the High Court and the DM and SP have to quash it following the court order,” he said.
Misra, a law graduate, is the only Brahmin from Uttar Pradesh in the recent Union Cabinet reshuffle.
